Legal Publications Service of Jornal de Barueri
1. Introduction
These Terms and Conditions govern the use of the Jornal de Barueri Legal Publications service (“the Service”). By using the Service, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with the terms, please do not use the Service.
2. Definitions
“Jornal de Barueri” refers to Link Três Comunicação Ltda, responsible for Jornal de Barueri, with CNPJ 30.182.386/0001-60.
“User” or “Customer” refers to the natural or legal person who uses the Service to publish information in accordance with the law.
“Publication” refers to the content published on the Legal Publications portal of Jornal de Barueri.
3. Object of the Service
Jornal de Barueri offers the Legal Publications service, allowing Clients to publish notices, balance sheets, reports, notices, meeting minutes, council deliberations, bid notices, meeting notices, relevant facts, communications and other required documents by law.
4. Customer Responsibility
The Customer is responsible for providing true, accurate and complete information to Jornal de Barueri. The Customer must ensure that all information provided complies with applicable laws and does not violate the rights of third parties. Documents must be sent in PDF format and follow the required guidelines.
5. Publication Acceptance Process
Acceptance and approval of the documents sent will be carried out by the Jornal de Barueri team, which will verify compliance with legal requirements and Service guidelines before publication. Documents submitted outside of the required format or that do not meet the guidelines may be rejected.
The types of content we consider unacceptable include, but are not limited to:
– Dangerous content, including those that incite violence or promote illegal activities;
– Deceptive or fraudulent practices;
- Gambling;
– Content that incites harassment or hatred;
– Manipulated media;
– Terrorist content;
– Sexually explicit content, including exploitative material and images of child sexual abuse;
– Violence and bloody images;
– Vulgar or obscene language;
– Spam or content that violates Brazilian laws.
6. Payment Terms
Publication will only be carried out after payment has been confirmed, which can be made via credit card, bank slip or pix. Payments must be made in accordance with the instructions provided when contracting the Service. In case of default, the Service may be suspended until the situation is regularized.
7. Certification and Digital Signature
All publications made on the Jornal de Barueri Legal Publications portal are digitally certified and signed with an ICP-Brasil digital certificate, issued by D4Sign and signed by Link Três Comunicação Ltda, guaranteeing the authenticity and security of the information published.
8. Deadlines and Cancellations
The deadline for publishing information on the Jornal de Barueri Legal Publications portal may vary according to the number of pending requests and the type of publication requested. It is recommended to send documents in advance. If the request has not yet been processed, it is possible to request cancellation with 48 hours notice.
9. Rectification and Republication
It is not possible to edit or change a Publication that has already been made. If the Customer has sent an incorrect Publication, a new document must be published and the previous one will remain published, with a correction notice and a redirection link to the correct document. Both documents will remain published as a form of transparency and for legal purposes.
10. Penalties
The publication of false or misleading information on the Jornal de Barueri Legal Publications portal may result in administrative, civil and criminal sanctions. Jornal de Barueri reserves the right to refuse to publish information that contains signs of falsehood or deception.
11. Limitation of Liability
Jornal de Barueri is not responsible for any damages caused by information published on the Legal Publications portal. The information published on the Legal Publications portal is the responsibility of the entities that provide it.
12. Protection of Personal Data
By using the Service, the Customer authorizes the use of their personal data to process their publication request. Jornal de Barueri respects the privacy of its Customers and protects personal data provided in accordance with applicable legislation, including the General Data Protection Law (LGPD).
13. Confidentiality
The Customer and Jornal de Barueri agree to maintain the confidentiality of all information exchanged within the scope of the Service, except that which is in the public domain or whose disclosure is required by law.
14. Force Majeure
Jornal de Barueri will not be responsible for any failure or delay in the performance of its obligations arising from events beyond its reasonable control, including, but not limited to, health crisis and/or pandemic, war, terrorism, embargoes, acts of authorities civil or military, fires, floods, accidents, technical unavailability, strikes or shortages of energy, labor or materials. Furthermore, Jornal de Barueri is not responsible for problems related to the functioning of the website or the accessibility of social networks, which may be inoperative for various reasons, such as maintenance, server failures, cyber attacks, connectivity problems or other technical issues. This includes issues on third-party platforms such as Meta (Facebook and Instagram), WhatsApp, X (Twitter), Google and other companies that may impact the availability and performance of our online services.
15. Online and Print Publication
When contracting the Legal Advertising service, the Client is aware that the publication will be carried out on the Jornal de Barueri online portal. To contract legal publication in the printed newspaper, the Client must contact a specialist at Jornal de Barueri and send the document so that a quote can be made. In print, the budget is based on the amount of text that will occupy the page, while in digital the value is unique and fixed per document.
16. Changes to Terms and Conditions
Jornal de Barueri reserves the right to modify these Terms and Conditions at any time. The changes will be published on the Jornal de Barueri website and will come into force immediately after publication. By continuing to use the Service after the changes are published, the Customer agrees to comply with and be bound by the updated Terms and Conditions.
17. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Brazilian laws. Any dispute or controversy related to the Service will be subject to the jurisdiction of the Brazilian courts.
